Step back and take the wider view, on this and similar issues. There is a pretty nice chunk of change at stake for ALPA in dues collected.

On the flip slide there is less than zero for recovery of the L -CAL LTD over payments, which helps explain why ALPA isn't pursuing it. If successful, they would actually loose money.

They're not "pursuing" it because they have nothing to pursue. The language says the company has to consider it, they did and said not now. The misinformation going around about this subject is amazing.

Remind us when the company said they would "consider it" again? Sometime after many of us may be dead from old age.

What is amazing is the fact that in this case the union effectively said" oh, okay whatever you say, is okay with us,". And when you wonder why they laid down in this case where the pilots are owed millions, when they are usually so aggressive, see my comment in previous post.

If you read the language pertaining to it you can see that there is nothing the union can do that hasn't already been done, the company has chosen not to assume the liability right now. What would you suggest to change their mind?

The language pertaining to it? Don't know what language you are referring to specifically, but I do know the company acknowledged there were over payments on premiums, but decided not to refund them. ( No one is forcing them).

What would I like? How about a presidential grievance, like they do every time a group of pilots is owed money, where the union expects to collect dues for, instead of tucking tail and folding their tents. I realize they have already collected dues on the money paid on these premiums years ago, but it is the right thing to do.

I'm guessing you aren't owed any money from this.

According to the numbers put out by the IAH reps, which are really just a guess until the fund is actually valued, I am owed around $8000. The reason no grievance has been filed is because the company has not violated any sections of the contract, there is no way to force the company to assume any liability that they are not required to assume. I'd like the money tomorrow but I don't see it happening until more guys retire which reduces the liability.
