Then sue if you don't like it. This is what we are doing now. Using last 4, height, weight, eye color, and etc...there is no perfect way to do this. The assumption is older needs a little love and which is why this is the current method. I mentioned using who ever applied first, interviewed first as metrics but I didn't win.

Age discrimination ONLY applies to workers OVER 40, and just says you can't favor someone younger than 40 more than someone older than 40 strictly by age. But companies can do the OPPOSITE without a problem.

First it doesn't matter to me and the reason why the age determination was dropped years ago was because SOMEONE DID SUE!
My point is the current management is clueless about why things are done the way they are and that is why UAL lost almost a billion dollars in revenue in the last qtr.

Oh and I didn't know YOU had a say in how the seniority order of each class went, if you do don't be part of the problem and do a little study about how this airline continues to stumble, and at best, be mediocre in a world of mediocre airlines.

Again you are putting old united to new in regards to lawsuit. Old united really had some bad practices and thus almost more lawsuits than any major. However, we are starting to act like the 80s because of a certain mentality.
My job here is not hinged on my job here. I have a very lucrative business besides here so I don't need the threat. History repeats itself when people can't let go of the past (and this old monster is rearing it's united head). This may seem harsh but even mentioning rebranding the company without rhapsody in blue caused a huge fight in ORD and you see who won. There is a one sided view that we need to shake. History is in the past in my opinion and we are not old united or old continental.
I tried to have a say in many things but was drowned out by old bloated history. I've moved on and do the best I can to make this company better every day. Mediocrity exist if you allow it. I am a professional and expect those around me to be the same.

A bit confusing but I believe you are saying you are just a pilot at UAL and have a side business which makes enough money so UAL can go under at anytime. Or are you saying you are a management type at Whacker Drive? Not quite clear which it is.
If it is the former then I assume you have no life when not flying other than working your second (or maybe primary) business.
What ever your personal situation is most will disagree about past practice and history with you. It is always an arrogant mark to say anything which even implies the "we know better now" attitude. The courts are based on case law and past practices of what is acceptable when new cases are brought forward. While the idea of seniority order based on age alone is a past practice, age discrimination lawsuits are not. The very reason the age 65 rule was applied is because of many factors with age discrimination being one of them.
Your reference to marketing the airline with the "new" campaign isn't about returning to the old so much as it is presenting an idea of customer service to a new age group of travelers. These travelers want new technologies and associated methodologies to fit their standards of culture and service and it is marketing's job to get that message and perception about United out to potential customers.
As a pilot my basic job is the same as it was the day I got hired. The difference is today I have technologies at my disposal only being dreamed about at the time. I started with two VORs, two VHF radios, two ADFs, a mono color WX radar, no ACARS, ARINC for all communications via voice, no autoland CATII manual land from 100' no autothrottles and so much less when compared to today. You know what I would never go back to the old tech and yet at the time it was the best UAL could buy.
My point? Somethings won't change, like lawsuits and how people need to be treated, while others we need to embrace.
Love the tech and so do our customers, now it's time to get the money as we provide the service.
