Because (to the best of my knowledge) the NMB doesn't have anything to do with the SLI.

The JCBA is now negotiated with the help of a mediator, once a TA for the JCBA is sent to the membership, the clock starts a defined timetable for the SLI that will more than likely be decided by an arbitrator.

JCBA - Mediator
SLI - Arbitrator

Does the clock start when it's sent to the membership or when it has been ratified. If they send a crap contract to the membership, the SLI could happen before a contract.

All correct...except..the SLI will more than likely be decided by arbitrator(s). As we will have a 3 man board like DAL/NWA.

The actual arbitration proceedings cannot take place until there is a ratified JCBA.

Interesting that nobody has commented on this tidbit from yesterdays UAL MEC update:


"This week, our mediator from the NMB was changed to Mr. Gerry McGuckin. It was determined the previously assigned mediator had a potential conflict of interest because of his previous employment. According to the NMB website, Mr. McGuckin joined the National Mediation Board as a Mediator in September 2007, and serves the Board in airline and railroad cases.


During his 29-year airline career, McGuckin gained extensive labor relations experience, including Merger Committee co-chairman for the PeoplExpress pilots, elected representative on the ALPA Master Executive Council for both Braniff International Airways and US Airways, and ALPA chief negotiator and negotiator for over 12 years at US Airways.


McGuckin was previously the mediator between the pilots and United Airlines in Section 6 negotiations prior to the United-Continental merger."

Would still rather see all that on his resume than a history of airline management jobs prior to becoming a mediator. Besides a mediator can't impose or make sides come together over issues.
