I think what he was getting at is that CFRs can be enforced only with limited fines, not serious criminal sanctions such as prison. So more like civil justice, under admin law as you said.

Important to note... *SOME* CFR's have companion federal law (USC) which in some case DO carry criminal penalties, ie prison. That's not just in aviation but other regulated sectors as well, such as SEC-land. Notable in our case is that the USC carries prison penalties for DUI while conducting common carriage (planes, trains, buses, etc). That would be in addition to FAR civil sanctions and any state/local DUI criminal sanctions.

Is it possible that they (incorrectly) has the mindset of "it's a charter and they own the airplane today so they can do what they want"?

We did a lot of charters at allegiant, and I've seen this displayed by crewmembers before.

impossible to know what they were thinking, but that was always my guess. I doubt they intentionally broke the rules, it’s usually ignorance

I'm sorry if this comes across as obnoxious, but do some pilots really need someone to to hold their hand and issue powerpoints to read a book at this stage in life?

the avg pilot doesn’t spend time in the books unless they’re going back for recurrent. Avg because there those who do
