This is an interesting point. I just read through that clause of the agreement, seems pretty iron clad. Makes me wonder why there is convincing needed and why haven't annouced an appeal already.

I bet JB/NK ammend the merger agreement. JB agrees to appeal and extend the Outside Date to July 2026, in exchange for a price recut. Otherwise the appeal is hollow since the process would most likely take them past the July 2024 date, allowing JB to back out at that point.

Additionally, I think their chances of approval are better at the Supreme Court level. It may be a long road, but I am regaining optimism.

Im a JB guy, hopeful for the NK merger. JB is the Miata of airlines. It is always the answer.
