I give it less than 50/50 that JetBlue appeals the ruling, especially given the terms of the way this deal was structured. What I see as more feasible, though still highly unlikely, is JetBlue dropping the deal, renegotiating terms (buyout price, and such), then move forward with a new deal in hopes that a more favorable DOJ is in place and the new agreement wouldn't go to a trial again.

Not to mention theres a new incoming CEO of Jetblue. If I'm the new CEO of Jetblue, last thing I'd want is the stank of a failed merger dragging on for another year, this seems like a perfect opportunity to pivot away. Or if they are going to play the merger game some more, take a shot at Hawaiian.

I don't see this as hopeful. If Spirit is having to convince Jetblue to appeal, that means that Jetblue has indicated that they don't want to appeal/they don't think an appeal would be successful. Not saying they won't appeal but, I would be much more hopeful if they were both on the same page.

Both Jetblue AND spirit have to agree not to appeal. It’s in their terms of agreement of the merger.

they have already paid nearly $400 million of that to shareholders. They still owe $70 million to NK directly when deal is officially dead. So they ‘only’ have 70 million left to pay. Give or take a peso or two.
