Out of principle I still hope JetBlue does not get to acquire Spirit. They panicked when F9/NK merger was announced and were told time and time again, thanks but no thanks. Would be awesome to see the judge tell them to go pound sand, having to pay NK 100M and then we merger and become the largest ULCC in the country. That being said, who know what will happen.

In a addition to what others have said, I think this is just factually wrong. JB claims it had approached NK management privately on more than one occasion, and were turned away. Not on the merits, but because NK management were planning or actively working on a sweetheart deal with F9 based on their previous inside relationships. The announcement of the NK+F9 merger, without NK having ever sought any other bidders for the shareholders simply meant JB had to take their offer and campaign public, as it had turned into a now or never situation. That's not "holy moly I'm so scared of NK+F9 let's panick".

In the only time in modern aviation where it’s literally possible to get hired anywhere in short order, a Frontier merger would be the only thing that would push me to leave all of my Spirit seniority on the table and start over. I think a lot of pilots are ready to click submit on new applications elsewhere if the JetBlue merger does not get approved.

I read an interesting analysis about motivation for settlement by the DOJ. Because the NEA is in appeal and could take a year or so to resolve in those courts there exists a possibility where Jetblue wins the Spirit judgement in October and then later down the road the NEA ruling is overturned or changed. By the DOJ settling the Spirit case now the DOJ could insist that Jetblue walk away from NEA even if American is successful in their appeal.
