Almost no merger, whether under the purview of the Federal Trade Commission, or in this case because it’s a transportation company the Department of Justice, will be approved without some form of concessions or stipulations. The FTC rubber stamps the overwhelming majority of mergers, and presents the concessions to the taxpayers as a win, and the small antitrust dept at the DOJ usually does the same.

My point about the FTC was prior to the current administration, it’s obvious where the various government agencies are getting their marching orders from.

I know it’s a Paywall but basically they think this merger deal is dead on arrival.
I mean, I know we have the Biden ministration to deal with but still it’s comes down to a Reagan appointed judge. What am I missing? What do y’all think?

Seems somewhat arrogant to describe it as "saving" the deal. Saving it would be trying to cobble together something else after the judge ruled against it (i.e. an appeal). We don't live in a country where one branch of government rules by decree in a vacuum, this is the process. They either strike a deal behind the scenes now, or it plays out in court. Lawsuits are always a coin toss, but I think it's 51/49 in our favor. But what the hell do I know.
