Talking with one of our union guys, if JB wins in court and the DOT inserts itself to block the merger, JB will start suing for damages at that point….and win.

That was also my thought. How in the hell could the DOT have a leg to stand on, blocking a merger for antitrust issues, after the court deemed it NOT an antitrust issue? I did realize they didn't state again that they would block it in that article. They hide behind "we won't comment since there is an ongoing trial". How would saying again what you said before affect the ongoing trial?

All bark....waiting to see if there will be a bite.

That doesn't scare Fed bureaucrats.... they get to grandstand until they don't, and any fines are paid by the taxpayers.

What Mayor Pete will say is that he isn’t “blocking a merger”, and the companies are free to merge together and do what they want, they will just do those things without an FAA approved operating certificate.

The reality is that ol’ pothole is just sabre rattling, trying to catch a headline to remind people he still exists, and more importantly signaling to whoever wins the democrat nomination that he will 100% tow the line.

if it comes to it JB could just pull a SW/AT and slowly transfer the assets to the JB certificate.

I would make it more difficult and costly but ultimately the DOT can’t stop it.

If they take that stance, JB could probably still sue for the cost associated with that process due to the DOT's refusal to issue the certificate for reasons the court already determined not to be so. But anyway, if this merger is approved, I bet the DOT won't fight it much. Just barking.
