except the jetBlue lawyers literally ARE the defense. For the DOJ attorneys, it’s their job to be more aggressive, it’s the defense attorneys jobs to rebut the things that are brought up by the department of justice attorneys. I think that the jetBlue attorneys are doing a fantastic job in my personal opinion.

Doesn't the defense get to call it's witnesses and focus on it's case after the DOJ is done? Right now just crossing as the DOJs witnesses are on the stand.

Also, how exactly does aggressively cross examining executives from your own companies help your case? This isn’t Law&Order where there’s some bombshell confession on the stand or smoking gun DNA exhibit or impassioned closing arguments to tear jerk a jury. This is about clearly laying out facts and statistics to an experienced judge who will then decide whether or not the merger violates the law.

Don't forget, trial costs are of no concern to .gov agencies. They are billing the taxpayer.

The big problem that the DOJ has in this case is that the Clayton Act's concern was 'substantially lessening the competition'.
Where Jetblue's team needs to emphasize is that the legacies have gone with Basic Economy fares that are designed to match ULCC fares. These fares need to be considered when one looks at the ULCC pricing model and competition.
