Delta, United, Southwest, Avelo, Sun Country, Breeze, Frontier, Allegiant all have counsel involved with this thing. It looks like they are requesting the court to seal confidential business info that the DOJ was able to obtain in discovery and they don't want the data turned over to that citizen lawsuit that is also pending.

Lots of depositions including Allegiant, Frontier, among others.

Lawyers are going to come out ok on this one either way.

courtlistener.com has compiled all of the filings since March when the lawsuit was filed. A lot of stuff is redacted, but there are a lot of public motions and the pre trial stuff was filed last week from DOJ and Jetblue
so you can get a sense of the real argument and schedule of events with the expert witness list among the pages.

One of the witnesses the DOJ wants to disallow is Sara Nelson the AFA union president. Surprising stuff.

Spirit itself recognized that a transaction like this one is “exactly what the antitrust laws were designed to prevent.” T
Very hopeful, that it is made clear to the judge that this quote was based on a JetBlue & AA NEA, which is no longer an obstacle.

Having read the JetBlue position, they make a damn good argument as to why the merger not only should be approved, but that JetBlue has actually gone above and beyond what other airlines have done in the past to facilitate competition in certain markets with regards to their mergers…. Haven’t read the Govt’s gobbledygook yet…

Government says things like, "sure you have made divestures and agreements but those arent finalized, and even if they were, there are no guarantees that allegiant frontier & other ULCCs will use them in the same way spirit did"

damned if you do damned if you dont for JetBlue/spirit. I'm really curious how them strongly selling unbundled seating for the "conscious consumer" and the DOT condemning such actions is going to play a role.
