Just a cursory look but I didn't see any other motions that laid out an exact schedule like this new filing.

Maybe this new start date will stick.

Nah it’s the existing trial docket pushing the start of a new case back, a fairly common occurrence.

If there were back channel negotiations going on this never would have gone to court in the first place, as most mergers of this scale are the product of agreements and concessions. The DOJ wants its day in court, ideally a precedent setting verdict, but at minimum a “we fought for the little guy, but corporate greed prevailed” tagline for the coming election year.

What are the latest numbers for Spirit and/or JetBlue purchasing new aircraft over the next few years?

The reason I am asking is I'm trying to figure out if the new aircraft coming in outnumber the A319s that are being being removed from the fleet as well as the NEOs that are not able to fly. It does not appear so from what I am seeing but thought I would ask on here.

Reading the pretrial brief that was filed this week by the defendants it is mentioned that Spirit has deferred aircraft deliveries that were scheduled between 2024-2027 in addition to mentioning the forthcoming Q3 large loss.

"Moreover, softening demand for domestic travel, rising costs, and various operational issues have worsened Spirit’s already unprofitable operations since the COVID-19 pandemic (it last turned an operating profit in 2019): Spirit recently estimated its third quarter 2023 operating margin will range between negative 14.5 percent and negative 15.5 percent.49 In light of its current financial condition, among other considerations, Spirit recently deferred a large number of aircraft that it formerly had scheduled for delivery between 2024 and 2027."

Trial scheduled for 20 days. 70 hour time limit divided evenly between both sides for testimony and cross chess clock style.

Amazing the number of airlines and lawyers involved in this thing when you read through all of the motions.
