Around 2006 I found myself in Tempe, AZ and took the chance to meet with some America West training guys. They weren't surprised to see a Spirit guy on the doorstep. They said "You've just been Bill Frankied! Welcome to the club". I hadn't learned what they really meant, but we all sure found out and we lived the Franky effect resulting in the eventual shut down of the airline 2010.

He may be 200 years old but he's still Chairman over there.

Indigo is a fate worse than Mesa and what an unfortunate education our bright eyed group would learn at F9. Good for me personally, as I have big ideas regarding cross utilization. After all, no reason pilots should be sipping coffee with perfectly good bags to be thrown and pilfered. Assistant to the VP of Inclusive Cross Utilization would be my career goal. Then I'd teach at Riddle.

Huh? Time limit? Where'd you find that info on having a time limit before the end of the year?

If that were true we'd already be ch 11. That's obviously not a strategy.

Not so. If we went Chap 11 management would likely lose their golden parachutes.

Does not mean it's not a strategy, the conditions just doesn't call for that desperate of a strategy in their book.

For anyone interested in more Merger talk here is a great 1 hour podcast with a former litigator discussing the case:

https://www.youtube.com/watch?v=jI6CzBXFsUo
https://podcasters.spotify.com/pod/s...49ck/a-aaec5g4

They go over pretty much every facet you can think of in the trial:

- The Judge & the fact that there is no jury (+ with him being semi retired, and choosing to take this)
- The "leaked" documents addressing a price hike
- The Stock Prices
- Spirits past statements about JetBlue purchasing spirit will violate antitrust (with the NEA)
- Divestures
- The JetBlue Effect statements during the NEA case, and how its not a slam dunk for JB in this case

& more

Nothing much new for us on the inside, but it’s nice to see those on the outside see how weak the DOJs case is. Weak as it may be though, their comments on the judge gave me some concern, as did the transfer of certificate debacle that could ensue if the DOT gets involved…..

Thanks for sharing!

For the DOT, the guy on the podcast made a good point that if the case was already heard and won, what grounds will Pete stand on to just block the certificate for a reason a judge already say is not the case? Also B6 can still close and find other ways around it to combine everything, probably more annoying and costly I'd believe.

That was a good listen though. Thanks DrSmac

I actually watched that today too! It was interesting to hear them talk about it in such detail. If I am being honest, all the points they went over more or less gave me confidence that the deal will in fact go through.
