The appellate courts are always at their disposal, but if the judge rules in favor of the merger things would proceed unless the DOJ is able to obtain some type of injunction in the meantime. Still there would have to be grounds for an appeal for it to be heard, and it would have to be something egregious to obtain an injunction while that played out. I would think the DOJ would be hard pressed to find some type of Constitutional violation that would cause the SCOTUS to even touch an Anti Trust case with plenty of precedent for airline mergers.

I thought JetBlue/AA would succeed in the NEA case….maybe JetBlue just has crappy lawyers. I would not be shocked if this merger is struck down as well, this company can’t get out of its own way and fumbles the ball. Probably less than 50/50 it’s approved.

NEA was decided by an Obama appointed judge
Merger will be decided by a Reagan appointed judge.
Completely different ideology and interpretation of the law.

Not really. The NEA case is and was a loser. Read the whole decision and you will see how poor a case it is. Lawyers could only put so much lipstick on that pig. Blewjet knew it wasn't kosher but used to to get through covid. Merger is a easier case to argue.

But to your point, yes, thats the preview from the Gov; less airlines means less competition. Some could argue that if David gets a slingshot, he can now finally fight Goliath.

Damn. Owens has a tough time trying to get those words out. As he was a former NFL player, sure seems like CTE isn slowing his cognitive functions down.

Owens point was great but not well stated. He could’ve crushed what Pete was saying if articulated well. Small airlines that cannot grow quickly bc of aircraft order backlogs have to merge to compete with the big four otherwise they are not actually providing any competition. The only solution is let the small airlines merge or break up the large ones. Pete talking about Pepsi and Coke was so off base. We aren’t talking about delta and United merging and AA and southwest merging dumbass.
But he mumbled and stammered on. Oh well
Also the indirect irony that Mayor Pete was using essentially a “slippery slope” argument towards airlines; the same type of argument the anti gay marriage groups made towards gay marriage, but I digress
