They can, and without having to go to court according to CFR title 49.

Nope. And this conservative supreme court has been itching for another opportunity to roll back the Chevron deference doctrine, which most federal agencies have been using to usurp Congressional powers. (OK, and a lot of Congresspersons have been using to fob off their agenda on executive agencies so they can dodge responsibility). I predict that any attempt by DOT to inject themselves into this deal for political purposes will boomerang rather badly.

Maybe I don’t understand the real implications of this, but couldn’t a future JB/NK just transfer all NK planes (the only thing of value tied to the actual operating certificate) to a separate holding company controlled by JB and then those assets leased to Jetblue Airways for $1/year?

Section 1 lays that out on JB side, not sure how NK section 1 reads.

As long as all aircraft are operated by Jetblue seniority list pilots (assume JCBA and SLI are complete) then airframes can be on whatever certificate the company wants.

Even more leverage with the JCBA; can’t do any aircraft transfers prior to an ISL and can’t do a ISL before a JCBA.

This administration especially has no business running an economy. It’s been controlled flight into terrain since Day 1.
