Except the DOT/Buttigieg said that he’s not going to transfer the Spirit FAA Operating Agreement over if the merger is approved by the courts. Which is under his sole ability administratively.

Nope. And this conservative supreme court has been itching for another opportunity to roll back the Chevron deference doctrine, which most federal agencies have been using to usurp Congressional powers. (OK, and a lot of Congresspersons have been using to fob off their agenda on executive agencies so they can dodge responsibility). I predict that any attempt by DOT to inject themselves into this deal for political purposes will boomerang rather badly.

Maybe I don’t understand the real implications of this, but couldn’t a future JB/NK just transfer all NK planes (the only thing of value tied to the actual operating certificate) to a separate holding company controlled by JB and then those assets leased to Jetblue Airways for $1/year?

Even more leverage with the JCBA; can’t do any aircraft transfers prior to an ISL and can’t do a ISL before a JCBA.
