News on the new Skywest pay package
The skywest agreement may actually give Skywest pilots more legal rights than the pilots of a union contract under the RLA. Under the scheme in the RLA there will be a system board of adjustment half company management and half pilots. The vote will be split and they pick a "neutral" arbitrator. The arbitrator makes money by getting picked for mediation. They often side somewhere in the middle meaning the pilot gets screwed. On the other hand a court will give the pilot what the agreement says.
Assuming the pilot has the financial wherewithal to pay for legal fees, such as DD, the court will only affirm whatever federal rights the employee was deprived of by his employer. The courts will do nothing about agreements made by organizations not recognize by the NMB (at-will employee's). Those extra federal rights of a contract are afforded by the RLA to union pilots.
Also, the neutral you speak of, are listed in the NMB recognized collective bargaining agreement. Meaning, management cannot unilaterally pick the list of mediators they can use. It is negotiated between management and the pilot union. And the pilot union will not negotiate to allow a neutral that has a history of unfavorable rulings against the pilots either. So what ends up happening is that neither side gets their "partisan" on the list. Basically, only the ones who both sides agree on. And then, if there is a need to use one, they are chosen by the alternate strike method. The whole process basically makes it so the most neutral neutral is ultimately chosen. And it's not like there is a history of company wins when it comes to arbitration, on the contrary.

Does the Skywest pilots handbook (or whatever it's called) include any compulsory mediation requirements, an arbitration clause, discussion of any “cooling off period” or “self-help” provisions or restrictions. Such provisions are included in most (if not all) airline collective bargaining agreements. It would be up to the individual pilots to FUND a very long legal battle if push came to shove.
Take a look the lawsuit going on with a few former Skywest flight attendants trying to sue over Fair Labor Standards Act violations. Case filed 3/6/2015 and it's still going on. https://www.classaction.org/media/pd...-v-skywest.pdf

Enough with the Union thing!!! Its been hashed out way to much over the years. And in the 45 years of SkyWest all that comes up is the DD thing. That was more of a feud between two people.... he said he said two people that didn't like each other... If it gets bad a Union would/will happen easily.. just hasn't yet.

The reason you don't hear much is because SGU has censored communication through internal email, you have an EB that is all too happy to play nice and roll over, and not too many are willing to take on the David v Goliath role against the company.
