I think what he means is that it may have been the F/O's leg and he may have performed the take-off. However when they realized they were going to ditch, the captain took control of the airplane to make the landing.

I don't believe there is SOP...in an emergency the captain's authority and discretion is used to determine the right course of action. Most captains at my company have said if there is an emergency and it was their leg, they would likely transfer controls to the F/O so that they can assess and concentrate on dealing with the problem.

That's most likely what I would do, until maybe the last 4-500 ft!

There is a migratory bird pattern that transits the New York area in the general vicinity of the city. Given that this is mid-January, I doubt if they were migrating. Probably just traffic in the local pattern.
