I agree with mostly everything you’ve posted in regards to the pilots failing to fly the airplane correctly. However there is a huge amount of precedence in aviation showing that nothing which is inherent to the flight control systems or computers controlling them should be designed with a single point of failure, that’s what they did. Is it criminal? I don’t know. I’m not a lawyer. But the smart people at Boeing who are designing these systems have decided to lawyer up. Probably not a bad idea, I’d do the same if I were them.

1 week after the 737 MAX is back flying, no passengers will remember.
Airlines who have them or plan to buy them won't have any problem either. Instead of saying, "Enjoy flying on board our new 737 MAX" they will say, "Enjoy flying on board our new 737" or "Enjoy flying on board our newest aircraft."

Given that anyone can sue anyone for nearly anything in civil court, the threat of a civil suit establishes nothing, but the insinuation is enough to warrant retaining legal counsel simply for self protection.
