To me it seems like all of them - the CA, the gate agent and FA - have discretion. I have been upgraded on DAL (capt told FA), Air Tran and US Airways. Once on US Air I was walking into the plane looking down at my stub for the seat assignment when I realized the gate agent had given me seat 3A. I stopped by the cockpit to say hi, and by the time I walked to my seat, another jumpseater had taken my first class seat! of course I said nothing and just walked back to row 28 or something like that, but it sure woulda been a treat to seat up front.
another thing I noticed is that I tend to get exit row seating. I don't know if the gate agent does that on purpose but it's a nice gesture, with the extra leg room and all.

I get it all the time, on various airlines. If the airline charges for first class upgrades, then they are likely to have an empty seat or two up there (personally I think they should upgrade their frequent flyers for free, in seniority order). I'm pretty nice to the CSR's and FA's...often it's the FA's who grab me from the back and send me to first after the door is shut.
I always travel in uniform, I think that helps too.

when the loads die down in the winter you should be able to get first class pretty much on a weekly basis. my personal best was january where i got first class at least 5 or 6 times in a row. but the flip side to that is i got no first class at all this summer

Yeah I don't like wearing my uniform, but it sure helps. I've sat in coach, then the purser came back and said I could sit up front. Doubt he would have known I was even a commuter had I not been in uniform. I ride on AA alot, and its hit or miss sometimes. But the loads def seem to be lighter as summer ends. Even last night on a Friday, things were wide open.

This has been my experience...actual during peak, first class during off-season.

Wear your uniform neat, smile, and give the gate agent a little flirting to make her feel she's alive for a reason

If not....plan B...Just like Sharky said, make the F/A's feel special and make em feel like their still 20...
IF he/she is plain B!tchy, say Hi to the guys up front and ask if it's a full boat if they would mind you sitting up front.....
Sure they wouldn't have a problem and usually they will ask where they got you seated and they will tell the F/A to give you an upgrade if it's open

Yeah I work for Skywest and use NWA, and have gotten 1st or exit row 75% of the time out of MSP. NWA gate agents at MSP rock.
