I am posting on this thread against my better judgment.
In litigation, parties make their case by presenting evidence to the trier of fact (this could be the judge if a bench trial, or the jury if a jury trial). Probable cause is not evidence. If one side offers this evidence, the other side may object and the judge rules on its admissibility. There is a lot that goes on in trial that the public or the media or wannabe pilots do not understand. And having not heard it, there is no way for me to say whether anything from the FAA's investigation is admissible or not. It is not difficult to imagine that the NTSB and FAA investigators will be called as witnesses. Their testimony is evidence, but also subject to objections. A subpoena duces tecum will be issued and the documents they bring in is considered evidence.
Credibility plays an important role in any trial. For the purpose of this board, I also look at the credibility of the individual posters. If you post something asinine, inflammatory or otherwise unsubstantiated, you have no credibility. If there are parties who sued the FO, list the docket number and the jurisdiction.
