The legislation, known as the McCaskill-Bond statute, was signed into law in December 2007 and is codified at 49 U.S.C. § 42112.

The statute applies when two or more air carriers are involved in a "covered transaction," described as:

A transaction for the combination of multiple air carriers into a single air carrier; and which
Involves the transfer of ownership or control of—
50 percent or more of the equity securities (as defined in section 101 of title 11, * United States Code) of an air carrier; or
50 percent or more (by value) of the assets of the air carrier. 49 U.S.C. § 42112 (b)(4).
When such a covered transaction "results in the combination of crafts or classes that are subject to the Railway Labor Act," "sections 3 and 13 of the labor protective provisions imposed by the Civil Aeronautics Board ("CAB" or the "Board") in the Allegheny-Mohawk merger (as published at 59 C.A.B. 45) shall apply to the integration of covered employees of the covered air carriers." Id. § 42112(a).1 In short, these Allegheny-Mohawk Labor Protective Provisions ("LPPs") require that the carrier make provisions "for the integration of seniority lists in a fair and equitable manner," including negotiation with union representatives and binding arbitration in covered transactions. The participants in this negotiation/arbitration process are the affected employee groups, and the carrier or carriers involved. The interests of unionized employee groups are represented by their union, while interests of nonunionized employee groups may be represented by employee committees or by the carrier.
First, Section 15 allows Jetblue to buy another carrier and maintain separate operations. They then go one to list ASM's as a restriction. When Jetblue violates this requirement how do we proceed legally? Section 15 also provides for a merger of operations upon another carrier purchasing Jetblue. There is no legal method for Jetblue pilots to force a merger of operations unlike a CBA.
Second, Section 15F provides for a $2,000,000 million dollar fund to be triggered upon a transactional event. What is not clear is how this money will be dispersed. What is clear is this amounts to less than $900 per pilot which is supposedly dispersed AFTER you exhaust your own personal resources.

Everyone in the pool is still in Phase 2. The next email that you will receive will be the one stating that you have been conditionally recommended for hire. It is conditional since your drug test results are only valid for 180 days and that they are not processing anyones fingerprints since they only have a 30 day shelf life.

Alright! This turned out pretty well. Both e-mails received. Conditional Offer e-mail received. Anyone have any new class info? Is it still the case that classes will stop after March and resume in July?

Heard this statment from recurrent last week. Earliest classes in late aug, plan on sept. Don't worry the waiting is the hardest part!

I believe the last earnings call showed we have about 128 firm orders to come by 2021. All subject to change ofcourse. We will lease back or sell off some frames that's a fact. How many total frames that we end up with is debatable. Even with 75% retention of that growth we will still need another 1800 pilots by 2020ish. That is assuming no attrition and that we are still jetblue in 2020.

They seem to have our growth managed now vs. the expansion into oblivion plan that we were on in 06-08. If they could just manage to fix our retirement and benefits now that would be really cool.
