The ones at mainline don't count. 255 is the max number of outsourced flying. By moving the E-jets to mainline it allows them to replace them with 900's which delta is borderline over the limit. You are adding more mainline jets which is a good thing, however, it is not a scope recapture as is being said.

The cap is 120 for 76 seats;
Comair has 13 CR900s ; ASA has 2 CR900s, 8 on order; Mesaba has 41 CR900s; Compass has 36 E175; Pinnacle has 18 CR900s ; Shuttle has 16 E175s; Skywest has 21 CR900's
That is 147 76 seat aircraft + 8 on order giving a total of 155 aircraft. The cap is 120. If you move the 36 E175's to mainline, that brings it to 119. Under the cap.
The max cap is 255;
ASA operates 39 CR700s; Comair has 15 CR700's; Skywest has 13 CR700s
That's 65 70 seat aircraft. That's 212 total 70+76 seat jets. If you shift 36 E175s to mainline, you get a total of 176 aircraft. The 120 cap no longer applies in the 3 to 1 exchange and delta can buy 79 more 76 seat aircraft.
If you do not add compass to the list, Delta must take 35 76 seat aircraft out of service or put 70 seats in them. Given that they don't buy any new aircraft.
All of this is in scope limits. Ask your rep.

Thanks for the numbers Mesabah. I think you will see a bunch of 50 seaters taken out of service beginning in '10. They will most likely be replaced with 70 seaters. These numbers highlight the importance of getting this flying back. 212 aircraft is a tremendous amount of mainline pilot positions that need to be brought back for everyone's sake.

If Mesabah's numbers are correct, (and I have no reason to doubt them, he seems pretty well informed) is this being grieved by ALPA and if not, why not? I can see having a few spares.......but not 27!!!! Unless these aircraft are not configured in a 76 seat mode but in a 70 seat mode, this would seem like a major scope violation and should not be tolerated.

NO they cant, they are still limited to the 255 cap for 70 and over seats. The compass birds are an exception to that number. So if they are over the cap now, that would not include the comapass birds.
