We have two concerns with respect to complaints we receive on this forum.
The first concern is; could a post made by an anonymous user cause problems for us as a business? If there is potential for legal action to develop, it's prudent for us to take some action, like pulling the post or suspending a users account. Of course if the complaint has merit there is probably a violation of the terms of service (TOS) which again could cause us to revoke or suspend a user account.
Each mention of "alleged civil or criminal misconduct" in this thread is in the context of what Dreamlaunch Media Ltd., the owners of Airline Pilot Central, do in the case of a complaint that we receive. As I've mentioned before in this thread, we judge a complaint on merit and consider how our business might be impacted should we be involved in litigation. It's for our own self-preservation, and users protection.
It's important that you, and all users, understand that: If there was impending legal action against us in which a court would force us to divulge a users IP address(es), email address, and other specific account information that could identify a users true identity we would absolutely unequivocally involve the user in the proceedings. Additionally, a judge's order is the only way we'd be compelled to divulge such information.
The second concern we have when we receive a complaint is; does the post in question violate our published terms of service and/or forum rules? Occasionally it's a judgement call, although in most cases it's pretty clear whether or not a post crosses the line. Either way, we reserve the right to make that call as we see fit and any action is at our sole discretion. Some forums have a "penalty box", we do not. The forum rules and TOS are there to meet our goal to maintain a board for professional pilots to discuss piloting issues - like adults. If conducting oneself online like a responsible adult is problem, than this is clearly the wrong forum and we will not beg a user to follow our rules.
So for the user "Kill Bill",
- Is there a complaint about a post that has the potential to become litigation? Yes.
- Is there there pending litigation as a result of the post in question? Not to our knowledge.
- Did the post clearly violate forum rules and the TOS? Absolutely.
