The best way to make a statement would be for all airline pilots to openly boycott all such programs until the ruling is reversed or congress adds protections
This is also proof positive that our system of government has a major big loophole in the checks and balances system (letting judges make stupid decisions without recourse). Unlike everybody else in society, judges and lawyers bear essentially no legal resonsibilty/liability when their decisions destory industrys or get people killed.
Speaking of lawyers, here's some other food for though:
I recently spoke with a couple professionals who often provide expert witness services for attorneys (a chiropractor and a consulting forensic meteorologist). Both say they are routinely propositioned (bribed) by attorneys to falisfy information and give fradulent witness.

I let the FO's fly all the legs.........so you'll have to direct your comments to them.......... I blame all my landings on the autoland system (which does a great job I might add). Had a passenger ask if I was AF or Navy the other day. He guessed AF based on the landing......he was right.

If a crew member reported that the ramp was slippery because of deicing fliud, and the company didn't respond to the satisfaction of some lay juror: "Yeah, I think #@# airline is fully responsible because they encouraged their crews to use glycol and didn't change their deicing procedures to use sand paper rather than that slippery solution for deicing." - then the punitive damages skyrocket??
Are we on the verge of "Hey no witnesses, no filing of an ASAP or ASRS." ?

This isn't good. Hopefully we can get the ruling reversed. Just another example of how pilots have to be absolutly perfect. If anyone asks, I know I've never made a mistake in the air

If ASAP/NASA info gets used in civil litigation, how many of us have already filed our last report? I'd wager I have. The intended purpose and driving force of the program has been violated, no pun intended. We are on the slippery slope.
