No, a single pilot personally choosing to not pick up open time is not an illegal job action. Posting on a web board that people shouldn't pick up open time CAN be, and opens the door to lawsuits.
That being said, it is very easy to pull data and generate stats on many things, all of which can be used against you. Guys who started entering Mx items in the logbook at double and triple the rate pre-negotiations ran into some issues with the CPO. I'm positive they can pull your VDA/RSA rates too.

I heard you guys will be ceasing operations soon. Not surprised and a little saddened but it's probably for the best.
