That is incorrect. Continue reading down the page in the CBA and look at the examples. That exception is the 1 hour cut out allowing the company to build a pairing that finishes between 0000 and 0100 without triggering ADG. However if you’re delayed past 0100 ADG kicks in.

That's a good point out I overlooked, thanks. But as I read it now it seems they’re just emphasizing the ADG trigger is 1 AM, not midnight?? Here’s the cut and paste:
“Exception 2: A Pairing with a release time after 00:00 but prior to 01:00 shall not
cause an additional five hours of pay and credit for the final calendar day of the
Pairing.”
They give an example 2 day pairing B5230 that is schedule to finish at 00:22 (Flight 718) and credits 11:57. Then they give two examples of how the pairing finishes/pays:
"Example 1: if the last segment, Flight 718 is delayed and blocks in at 00:45, the Pairing would pay 15:00. (This includes the: 15 debrief)"
"Example 2: if the last segment, Flight 718 is delayed and blocks in at 00:44, the Pairing would pay 11:57 as published."

I just wanted to give you an update on your dispute you filed in DTS. We met with the negotiating committee last week to review their notes and discuss open issues we had. Your dispute was brought up and we had Jeff Harbison, the negotiating chairman, reach out to Mark Esposito, the company’s attorney. After both sides discussed it and reviewed their notes, the company agreed that if there are no window/aisle seats left in the main cabin, that EML seats should then be used.
So CHalk this up as a win for contract compliance.

This was spurred from them not assigning me a EMS space when it was available for a rsv assignment. Happened twice. You could say just get the EMS at the gate but that’s not the point. There’s also a chance that those EMS seats may not be available two or three days down line during poor wx.
So CHalk this up as a win for contract compliance.
