what is the feeling you guys are getting from the company about how they feel about appealing the judges decision?
more so because they’re obligated too?

a lot actually do get overturned but unfortunately I don’t think this will. I think the only indication JB wants it to is jf they apply for an expedited trial, or recut the deal for less money. All that being said, it’s pretty frustrating if JB wants to bail. They should have F’d off to begin with and let us merge with F9

Agree. This outside date of July 24 is there opening to negotiate a better price. The fact is Spirit's value and prospects have deteriorated substantially since the deal was originally made. Most analysts think JB dodged a bullet with the judges decision, whether they are right or wrong. Spirit should negotiate a much better share price if they want a hard push through the end of this process. Would be interesting to see if the Supreme Court would even agree to hear the case.

Agreed, they spent the whole case laying out their best defense of the merger. In order to appeal they need to show how the law was incorrectly applied. I know to us armchair CEO/lawyers it seems clear but that may not be the reality.
