Yea that makes sense, and the judge seemed to be unaware of these proposed divestitures. It looks like we’re wasting time and tax paying dollars to have this thing drag out one more day than it should.

Why would the government settle now? How does that benefit them in any way? If they lose because the judge rules in JetBlue’s favor they look like brave social justice warriors. If they settle they look like sellouts to whoever they are trying to impress with this politically motivated garbage.

As much as I’d love to see a settlement, or a dismissal that doesn’t allow an appeal, I feel the government is gonna drag this **** out for nonsensical reasons….. 🙄

In some ways I want to see this go all the way to a judge verdict. That will hopefully prevent the DOT from re-trying this case as well as set some precedent for future mergers (assuming it goes our way).

We don’t know if the DOJ has a losing case or the judge is leaning toward approving the merger! Why….because some guy in the courtroom was tweeting what is being said and being read with bias? It’s not just you, I keep hearing this narrative that the DOJ isn’t doing well in court.

As I said over on our forum, the government has nothing to lose. Their end game isn’t to save face, and it definitely isn’t to secure the best possible terms of a merger for ‘the people’ but rather swing for the fences at the chance to establish precedent. Additionally a long and expensive trial helps the anti trust arm of the DOJ justify its slice of the budget.

Eh so far they are really both saying different things as they have been the entire time. So far DOJs entire argument is "Look your honor, who cares about the industry as a whole and the big picture, if even one person doesn't have the ability to get on a flight paid for by a stimulus check, and if they do not have the ability to fist fight the gate agent then this whole merger should be shot down!"
And B6 is saying "Shhh pay no attention to the white claw drinkers who will be unable to get on a flight for 17$, look at the industry as a whole".
Essentially an apple to oranges argument. Most of the DOJs energy seemed to be spent on looking at the Spirit CEOS comments from the previous years so far. I would say B6 is winning, but its hard to say from a tweet summary lol.
To preface this, I am a dumb uneducated airbus driver who knows absolutely nothing about the law so please feel free to completely ignore me, or to tell me to shut up.
Unfortunately no play by play summary today, which I was really enjoying.

Do we really think it's going that well? (For it to be approved) Wall Street certainly doesn't think so. Not saying they are right, But asking for those who think Judge Young will approve, why does Wall Street have it wrong?
