Smarter people than us are betting we get a decision by Friday 5:30pm via the weekly options that expire then. I am a little confused as to why it took this long but there is probably a reason. If the DOJ didn’t meet their burden of showing harm or overwhelmingly did it would be a simple decision. That tells me it is somewhere in between.

Diane Alter is a merger/arb journalist and she seems to have some insight from the inside. She has reported "Re $JBLU $SAVE #DOJ the decision is indeed a top priority with Judge Young, and it is an all hands on deck situation. There is no update as to the exact day the decision will be released but the Court is aware of the interest of this decision."
I mention these people becuase this isnt their frist merger/anti trust rodeo and they have a better idea of the backstage workings at play.

As @LionelHutz_Esq has pointed out, there could be other factors we dont even know about, non case related, to a delay. Judge Young could have got covid over the holidays and has been recovering, as he pointed out, or any other factor.

I think in this particular case the “them” is Judge Young. I agree, the DOJ would like this decision to take 6 months. However, the judge said he realizes there is a time component to this case and would rule in a timely manner. He has a reputation of being an excellent no-nonsense judge. I think he understands the importance of this case (to both JetBlue and the industry as a whole) and wants his decision to be well written and on rock solid ground. My guess is it comes out sometime this week.
