I wish the defense would have brought up all the routes and entire cities spirit has pulled out of when they were even the only ULCC operator there. Spirit can pull out of anything any time. It doesn’t take a merger. Heck we just announced we are pulling out of DEN just last month. Yes Frontier is there but some of the routes we were the only ULCC and the legacies were crushing us. The DOJ has no idea how airlines work. They just want to stop any and all mergers. It’s a clown show. Hope the judge doesn’t fall for it but the JB lawyers didn’t make this key point about leaving markets exclusive of the merger.

I mean, nothing new was presented during the closing arguments afaik, they’re basically a recap. Not sure why people are now flipping the outcome to favor the DOJ when they’ve had a weak argument since Day 1, but now they might have had a “better” closing argument that simply restated their position using the same facts as they have been the entire time. Hopefully the judge reads between the lines and recognizes how dynamic this industry really is and decides accordingly.

JBLU's closing arguments were meh.
I was extremely disappointed with Mr Shores' response to the Judge's pointed question on whether or not more divestitures would be satisfactory to JBLU. He took a couple of minutes rambling on about this and that before meekly saying yes, that'll work. Contrast that with the same question asked of the DOJ attorney - 'no your Honor, there are no divestitures that will solve this problem'. No hesitation, just a rapid concise answer to the Judge.
Both sides cited precedent in antitrust trials but I felt that the DOJ's citings were much more clear than JBLU.
My decision to sell was about risk management. I was extremely overweight on SAVE stock which is why I made the trek up to BOS multiple times. It was not an easy decision for me to pull the trigger and sell everything, but I wouldn't be able to sleep holding much SAVE.
I'm not an attorney so I don't know how this will end; I deferred to attorneys who were in the courtroom.
As a pilot, I think that it's very logical that B6 and NK merge which is why I was willing to take such a large stake in SAVE. I still think it's the best thing for both airlines but I'm not willing to risk a boatload of money on what appears to be a coin flip.
