Well scratch that. It seems they canceled tomorrow's court day. So only Dec 5th remains for closing arguments

ALPA needs to talk to this Scheff guy and determine how much money B6/NK saves per day by combining operations. That number should be available to every pilot before we vote on any JCBA.

Something about "steping on ones (junk)" comes to mind, better to stop while you're ahead.

There are some theories floating around finance blogosphere on why JBLU decided to rest their case instead of having another witness.
I have to assume that the defense decided that they'd done enough groundwork on their case and are redirecting efforts toward their closing argument.

As a side note, I wrote down some of the comments here and on other websites and slipped a note to Jetblue's defense team on Monday. I highlighted two points:
1) There are very few barriers to entry to starting an airline; Avelo and Breeze are two examples. The reason why there aren't many new airlines is that it's a tough low margin business.
I also tossed in a Warren Buffett quote from 2007... 'if a farsighted capitalist had been present at Kitty Hawk, he would have done his successors a huge favor by shooting Orville down'

2) There is nothing to keep Spirit from changing its business model from ULCC to LCC, which would eliminate all of DOJ's arguments. Changing from one category to another has been done before; one recent example is Frontier going from LCC to ULCC about a decade ago.

Dr Hill had read my note and told me it was passed to the rest of the team.
Jetblue attornies touched on the second point during their direct with Scheff on Tuesday. He was asked something like what if Spirit changed to an LCC. Unfortunately, it was quickly cut off by the Judge who said something like 'why would they do that'? I wish that JBLU attornies had come back with 'because ULCC is a dying model'. And it is, from looking at NK and F9 quarterly reports. Not to mention that both Avelo and Breeze are losing money.

Anyway, I look forward to hearing both DOJ and Jetblue closing arguments on Tuesday.
