Everybody shops around and hires the expert witnesses that share their bias. Nobody hires an expert witness that shares the opposing bias.

This is going to a judgment. All the diamond hands Gamestop Bros out there are pitching some conspiricies to pump the stock. The case for the DOJ seems weak at best according to people who are in the actual know. But it's going the distance. Gonna be before Christmas or even after the new year to hear the judgment.
And if you take a day to go to court, you will see that Judge Young is a no-nonsense person. While he's tolerating the DOJ's feeble attempts to block this, he has likely drafted most of his decree written. He's not going to drag this out.

Someone from B6 did a solid, like Andy, and went to the court today. This was what he got from it:
"Went to most of day 13 of the trial today. Not much to add they just had an economist on the stand who said the merger was going to be bad and that all other economists were wrong. When b6 cross examined him they proved that most of his stats were outdated and did not take into consideration the fact that all but 4 or 5 of the 30+ examples either have been divested, exited by b6/nk, or had a new ulcc entrant since those stats were measured."

The Judge didn't seem to have a hard time seeing through piles of BS, and he's pretty up to speed on the industry.

Judge Young has already stated that he'll have a decision before the end of the year. I don't know why you think he won't do that.

From what he reported, I can say the DOJ proves JB case again today. The fact that the 30+ is down to 4 or 5 shows that the market is mobile and cannot be viewed from route to route. The market is national. The DOJ data is outdated.

I'd like to thank the crew of Jetblue 2052 for getting me here Sunday evening.
This afternoon, I will post what happened in court today. This will be the first day of B6/NK witnesses.
I pulled up an article from April where the trial was scheduled to start in October (which it did). The judge stated that he hoped to have a ruling before the end of the year.
I will stick with a personal expected ruling date of Monday Dec 11, 6 days after the end of the trial. Why? Because the judge is a no-nonsense person and I suspect that he has most of his ruling already written in favor of allowing the merger to proceed.
The DOJ really shot themselves in the foot by refusing to negotiate any divestitures, forcing B6 to unilaterally arrange some divestitures.

Only one witness today; Nicholas Hill a PhD economist. Here's a webpage on him: https://www.bateswhite.com/people-Nicholas-Hill.html
Talked a lot of economic details that covered economics/modeling and market impacts. I was able to follow it but I won't go too deep on details.
The Judge asked several questions for his personal clarification.
Dr Hill testified that Jetblue has a higher impact on lowering fares than Spirit. Also testified that Jetblue entering markets increases passenger traffic more than Spirit entering markets.
Most of Dr Hill's testimony refuted a DOJ expert's testimony ... Dr Gowrishankaran. https://econ.columbia.edu/econpeople...gowrisankaran/
Dr Gowrishankaran testified last Monday or Tuesday; I was unable to attend but reports indicate that he didn't do well as an expert witness.
I was very impressed with Dr Hill. He shredded Dr G's (I'm not spelling that again) testimony and report.
Cross examination by DOJ of Dr Hill: I felt Dr Hill did fine in cross; no blows landed by DOJ. I sat next to a guy who does analysis for investors. Here's a clip on him talking about the merger a while ago: https://www.youtube.com/watch?v=BFN_iXHdF78
Mr Cohen used to be on the fence about the merger; he now leans toward it passing. He's now in the camp that Jetblue is winning the case. Here's his company's website: https://mdcfinancial.com/?gclid=EAIa...SAAEgIgU_D_BwE
The schedule is now changing. Court sessions on Tues, Thurs and next Tues will be closing arguments.
This Fri and next Mon were cancelled. ... as of right now.
I expect a ruling around the 11th in favor of the merger.
