That would provide a much better method of increasing anti monopoly precedent than this case. This is more akin to the EPA trying to redefine a seasonal occasional mud puddle as a navigable waterway. They are practically begging to be slapped down for over reaching.

I'll be there the week after Thanksgiving in person ... assuming DOJ doesn't settle in the meantime.
The DOJ does have an 'out' on this; they can claim they got the necessary divestitures to allow the merger to proceed. IF that happens, expect the stock to rip higher due to short covering. Same when the Judge issues his ruling.

It is possible; I haven't looked at percentage of short interest here, although I'd think that the next few days will probably squeeze most of them.

That's higher than normal. It will depend on how many stockholders decide to sell quickly after the lawsuit goes away.

I can't remember for sure if the ticking fee counts towards the share purchase. I think it does, but not sure. I'm sure the $2.50 does though. So best we can hope for is $31.00. But possibly less with the ticking fee subtracted.

Deal price is $33.50, but then you have to subtract the $2.50 prepayment (already payed) and subtract the $.10 monthly ticking fee. Will be ~$30 give or take when JB has to buy the shares.

So someone who bought recently will get ~$30.00-31.00. Depending on if the ticking fee is subtracted from the $31.00.

You will receive $31.00 per share at the close of the deal. I believe the ticking fee is only deducted from the cancellation clause of $3.50 per share (approximately). Shareholders would get this if the deal does not go through. If you received the $2.50 prepayment and at least a $1.00 worth of the ticking fee then you would get nothing as a result of the $400 million break up fee. If you did not receive the prepayment then you would get some portion of the $3.50 - the ticking fee received.
