I don’t see why JB can’t make a tender offer for $33/share and have it cancel if they don’t get 51% of the 108mil outstanding shares.

Then make another proposal to buy NK at $24/share without the previous protections, vote to approve it, and so sorry for those who fought the tender offer. JB saves big $$$

I'm this current market, may just be able to pull that off with the institutional shareholders.

There are SEC rules that come into play once you exceed ownership of 10% of outstanding stock. Plus, the NK BOD can put a poison pill in place. It's not as easy as you make it sound.

Given how the financial markets are behaving, it may be better for B6 to sit back and watch this play out. NK's quarterly results and forward guidance weren't great. I listened to NK's conference call and I didn't get a warm fuzzy from management.

True, I listened to the call as well. They seemed so angry at Jetblue and like emotion was driving their actions.
