Institutional Shareholder Services Inc. conceded that Spirit’s board might be correct in concluding that the Frontier offer has a better chance of winning approval from antitrust regulators. However, the firm said, both bids carry regulatory risks but only the JetBlue offer includes a $200 million breakup fee in case regulators reject it.
Frontier now has a $250m breakup fee.

Yep. Doesn’t change the fact that the b6 offer is still 40% more. I don’t see how this will move the needle much for those voting no.

Of course it's biased. But that doesn't mean it's not true. When you go to trial the prosecution and defense bring in paid experts to bolster their cases. Their credibility and testimony often swings the case in one direction or another. It seems like this individual has quite a bit of experience and would most certainly play well in any litigation the government may try to entertain.
