Default Part 121 Regulation Question

Hi Everyone.

I'm scheduled to do a part 91 empty leg 2:50 followed by a Part 121 (Pax carrying) Leg 2:50, followed by another 2:50 part 91 empty leg. This will put me over 8 hours of flying. IS THIS LEGAL? since it's mostly empty flying or is it considered "commercial flying" since I'm being paid to fly these legs???

IIRC, the part 91 leg at the beginning of the duty day counts towards your 8hr in 24. The middle leg obviously does. But the last leg is legal to fly since it doesn't count towards the 8hrs.

Lemme see if I can find a reference for you and I'll post it later.

It is perfectly legal. You do have to be aware that when flying for extended periods (I personally dont thing 9 hours would count) there is a catch with the rules. Recently the FAA has cited a few pilots under 91.13, Careless or reckless operation when flying for extended periods in this type of case.
