Default Oh my, God..

I'm only posting this because it's so bizarre. Someone is actually slapping a lawsuit on God.

http://news.yahoo.com/s/ap/odd_suing...EHm0Fylczq188F

LINCOLN, Neb. - The mystery of one response to a lawsuit against God has been solved. Eric Perkins, an attorney in Corpus Christi, Texas, said Friday he filed a response to the lawsuit from Nebraska State Sen. Ernie Chambers. "It's kind of a turn on 'What would Jesus do?'" Perkins said. "I thought to myself, "what would God say?"

"Defendant denies that this or any court has jurisdiction ... over Him any more than the court has jurisdiction over the wind or rain, sunlight or darkness," according to Perkins' response.

As for Chambers' contention that God made terroristic threats, inspired fear and caused "widespread death, destruction and terrorization," Perkins wrote that God "contends that any harm or injury suffered is a direct and proximate result of mankind ignoring obvious warnings."

Perkins, who said he is a Christian, faxed one of at least two responses to Chambers' lawsuit. He said while he hopes the lawsuit was just a stunt by Chambers, "maybe his timing has something to do with world affairs. I'd hate to be that person who sat back and did nothing."

The problem of serving God a summons could land the lawsuit in the earthly scrap heap of failed legal actions.

But whether the issue goes before a judge may largely depend on how hard Chambers pushes the issue. The senator isn't asking that notice be served to God, but says in his lawsuit that if he doesn't get a summary judgment in the case, he wants a hearing — "if the court deems such a hearing not to be a futile act."

Chambers, a self-proclaimed agnostic, said he's trying to makes the point that anybody can sue anybody. He said his filing was triggered by a federal lawsuit he considers frivolous.

It's still not clear where a second response from "God" came from. There was no contact information on the filing, which turned up on the counter at the Douglas County Court office, although St. Michael the Archangel is listed as a witness.

Attempts to reach Chambers by phone Friday were unsuccessful.

I spent more than a few years in Nebraska, where Ernie Chambers serves in the Unicameral. (Go ahead, civics buffs, tell us what is unique about Nebraska and the Unicameral. ) Ernie is a kook, and his constituents are kooks for electing/re-electing him.

The second filing that "turned up on the counter" at the Douglas County Court office asks that the lawsuit be thrown out because God was not given proper notice, i.e., he was not properly served.

IIRC, Nebraska is the only state that doesn't have a state house/senate arrangement. Instead they have one ("Uni") elected body of "administrators" that serves in the "legislative" role of state government.

But it's been a long time since I took Civics...

He knows that the lawsuit is stupid. He was trying to point out that our legal system is out of control. You can sue anybody for anything. Whether the lawsuit has any merit or not is irrelevant.

It's over a Battle of Words.

Tory Bowen was a student at the University of Nebraska, Lincoln, three years ago when she was allegedly raped. The first trial of the accused resulted in a hung jury. Lancaster County Judge Jeffre Cheuvront, the judge in the retrial, has issued an ordered that those who testify in the case will not be permitted to use the words like "rape," "assailant," and "sexual assault." Of course, "sexual assault kit" is OK, but not "sexual assault."

Tory has refused to sign the order, and has filed a lawsuit against the judge so she can testify without fear of using a banned word. The suit claims the judge is violating her free speech rights.

There are actually three dynamics at work here. First is Ernie's opinion of lawsuits and the Nebraska Constitution. Second, there's his interference in a court case. Third, there's his opinion about God.

First, the frivolous lawsuit angle. Nebraska Senators have periodically offered bills prohibiting the filing of certain types of suits. Chambers objects, stating that the constitution requires that the doors to the courthouse be open to all. So, does that mean he wants to restrict frivolous lawsuits, or does he want to protect the right to file them? Every attempt by the Unicameral to limit them has been opposed by -- Chambers. So when Chambers claims that he’s merely trying to make a point about frivolous lawsuits - by filing the mother of frivolous lawsuits - his words ring hollow.

Then Chambers claims the suit is in protest to a lawsuit filed against U.S. District Judge Jeffrey Cheuvront, who presided over a sexual assault case in which the accuser was prevented from using the words ‘‘rape’’ or ‘‘victim’’ during her testimony. He has single-handedly decided that the woman's case is without merit. (Hey, Ernie, I know you're a special case, being in the Unicameral and all, but it's still the Legislative Branch. If you wanna be a judge, you need to pass the Bar Exam!) He apparently wants to stick his fingers in the judiciary process, too. Chambers said Bowen's lawsuit is inappropriate because the Nebraska Supreme Court has already considered the case and federal courts follow the decisions of state supreme courts on state matters. Chambers says, "This lawsuit having been filed and being of such questionable merit creates a circumstance where my lawsuit is appropriately filed. People might call it frivolous but if they read it they'll see there are very serious issues I have raised." Out of one side of his mouth, it's the Mother of all Frivolous lawsuits, and out of the other it's completely appropriate. But thanks for saving the taxpayers money by circumventing the system and doing the court's job.

Did I mention he's a kook?

Finally, there's Ernie's take on God. He's an agnostic who often criticizes Christians and skips morning prayers during Nebraska’s legislative session. The Associated Press quotes him as stating “‘There have been various groups, referred to as conservative, or Christian right, or whatever, who have used the courts to advance their very narrow, and in my view, bigoted agendas." This is a perfect opportunity for Senator Chambers to mock God and those who believe in God.

So, whatever his reason, or whatever his point, he's once again wasting Nebraskans' tax dollars.

Oh, did I mention he's a kook?

Actually, if he wanted to serve God a summons, it's quite simple.

Get a 25 foot copper rod, tape the summons to the end of it and then stand out in an open field during a thunderstorm with the rod pointed skyward.

You're certain to get his attention then.
