A good lawyer could probably argue that he was going to call in sick and not actually operate the aircraft. Not sure how that would turn out though. I don't think this belongs in the "tool of the day" thread, the guy seems like he has a problem and might lose his career. It's more sad than anything.
It's beyond reasonable doubt, like I said this is why they normally arrest pilots after they board... open and shut. TSA and airport cops should know that...
Does sound like he has a problem if he was in possession of an open bottle, in my experience with crews on a trip that's always the sign of a serious drinker. Sealed bottle that you bought on the road to take home, that's fine.
But he's in trouble with DL and likely the FAA for sure, HIMS best case.

I would agree with DL... the FAA??? Lawyers will put that issue to bed. Repatriation with DL after HIMS, let alone employment with another carrier??? I’m sure the individual will gain employment in another field of endeavor other than aviation.

That alibi has been used successfully, and there's no reason it can't be used again. Just say you were undecided and were going to self-evaluate right before performing any duties.

Getting back to flying after being arrested like this isn’t impossible. The fact his name made it to the media is going to be his biggest obstacle.

Maybe he was heading to his chief pilot office to self report and enter the program after finally realizing he was out of control. Was that his intent? Sure hope so.
