Gojet has no problem firing a person if it thinks they may get away with saving a dollar. If they save 250k by firing a person with cancer, 90% of the time the person does not have the resources to fight them. So in a year they may have 2 savings of 250K, 15 savings of 50k, and 30 savings of 15k, for a savings of 1,750,000 on the low end.
They usually don't just fire but first they give the person a check ride or a bad evaluation and then fire the person. They claim they fired the person because of the failure, not to save 250k. One person may sue and they will settle for 8000 because GJ is hard to fight. Another might get 35k. Every 3 or 4 years there is a 400k judgment. So, over 4 years they saved 7 million in medical payments, pay out 1,000,000 in settlements and judgments, pay their lawyers 1,000,000 in fees. They come out 5 million dollars ahead.
Sue GJ, it just does not care, it is already factored in.
The medical costs of the fired employee get pushed to the government, the spouse's insurance, or, now that they can't discriminate on preexisting conditions, on the plan of the next employer. Or, it the person can't get treatment, they just die.
That is our GJ.
