we have a contractual agreement that they will hire us (flow). Yes, I’m sure there are ways they could get around it, but the fact that they essentially have agreed to hire everyone of us when the time comes, makes it very difficult for them to then not hire you because of this.

I agree, it is probably much less likely for an OTS candidate to get a call by checking this box, but it’s different with the flow. They can’t just “not call”.

They agree to hire is when the time comes if we meet their requirements...aka getting vaxxed as flow pilots.

You are required to meet all new hire agreements upon flowing to delta. Aka you you’ll need both the yellow fever and Covid vaccine. Getting the Covid vaccine is literally required of all new employees at delta, whether it be a pilot, flight attendant, gate agent, dispatcher, ramper etc etc. The MEC made this very clear in the all calls. This is for both LOA 125 and CAP pilot. We are not exempt

OK. Reading is important folks. I never said we are “exempt”. I said, if you live in a state that makes vaccine mandates illegal, you can’t be denied employment for not getting it. And because of the flow agreement, it is very hard for them to “sort you out” due to this.

not to mention, it is VERY likely, any new hire that applies for an exemption will get it. If you read our union email recently, it even talks about applying for an exemption. This entire discussion was started regarding losing flow slots due to guys not getting vaxed. But there has been zero cases of that.

If you have a legitimate reason for an exemption, you can apply for one. It doesn't mean they'll accept it, but you can ask.

This statement is incorrect employment laws and applicable regulations/precedent are based on the jurisdiction of the employment. If you can show the court that you are even quasi employed in your home state then you would likely have jurisdiction their however if a finding of fact and conclusion of law does not show such employment the tribunal would use the justification of the employment for the choice of law.

maybe we can get off the discussion of if you need to be vaccinated to flow. We had one slot lost because someone decided that they didn’t want to flow after saying they wanted to flow. As of now, the union and DL are working on a timeline to ensure all paperwork is received in a timely manner to fill classes with people who are ready to go. If your vaccinated- you need to have your CDC card in by a certain date. If do not wish to be vaccinated, you need to have your accommodation request approved by a certain date. If you have concerns about the vaccine process, reach out to your ALPA rep, the ALPA lawyers or a private lawyer (not an APC lawyer).

Nope. You're wrong. Lol this is fun....

Airline crew members are subject to the laws of the state they are either headquartered or based. But not where you live.

There are a bunch of examples of this, for instance there are several states that require paid family leave for all private sector employees. If you live in Connecticut but work are a Delta pilot, Delta is NOT required to provide you paid family leave iaw with Connecticut's law.
