I wonder if it's stupid, or criminal. Have you ever heard of any entity failing to exhaust the appeals process when $44 million is at stake? The only way I can conceive of such a thing is if said entity intends to lose.

And I sure have never seen older pilots fail to be represented (and represented very well) within the union.

Now... if you're a certain part of ALPA, i.e. the part that controls ALPA, and you want to get a piece of the pie... but you can't put your hand so bluntly in the cookie jar... maybe you have members of a class (of which you happen to be a party) sue the entire organization for failing to properly represent you. Your incentives to defend aggressively are... lessened, aren't they?

I'm not very familiar with this case, and I understand that UAL really butchered the bankruptcy stake distribution, but conjecture and a modicum of logic both tell me something here definitely smells funny. As if losing $44 million straight up wasn't bad enough in and of itself.

Looks like UAL ALPA is in turn suing UAL. As the lawsuit turns!

I'm getting a new sign in page asking for a "user name". Went back to the home page, couldn't find any way to set one up.

With over 12,000 of us, we're nutz staying at ALPA. With the loss of most of the Pensions and the rape of our profession, the least we should do is demand them to lower our dues or we are leaving!

You understand that this was a negotiated settlement, not a judgement or ruling, right? The plaintiffs in this case had sued for over $200 million.

The appeals process referenced in the article was for members of the class to "opt out" and protest the settlement. To put the settlement in context, it's $44 million out of a $537 million distribution. I'm fairly certain ALPA was indemnified by UAUA in their contract, so it will be interesting to see how this settlement vice a verdict will be viewed by the court during the follow-on repayment squabble.

Problem is if there is no appeals, and ALPA National has the money (MCF) they have to pay prior to the suit against UAUA by UALALPA even goes to court. Would be nice to stop any payment or schedule until this part of it get settled.

Oh what a mess.......
