You understand correctly.

Bentwookie said his /her freeze expired next fall. Therefore, he/she will still be seat-locked on May 2, 2017 (the latest date, per the MOU, that the new language will go into effect). Therefore, he/she will be in the last 12 months of his/her seat freeze (only had 12 months to begin with) so the new provision will apply. The company did not include limiting language that restricted this provision only to those hired, say, after December 1st.

Bentwookie's question is identical to Example 3 in 22.G of the new PWA.

I would suspect that is not correct. The poster needs to go to the DALPA website and post the question there. I suspect in the negotiation notes there is clarification. The way I read the language it looks pretty clear it only applies to pilots under the new 24 month freeze. This was in the Q&A section.

Q: I am a new hire, and was hired in the previous 12 months. Will the new 24 month category freeze be applicable to me?
A: Changes to Section 22 G.2 will only be applicable to those pilots hired after date of signing.

Also note the actual language:

2. An entry level pilot will incur a 24-month category freeze. Exception two: A pilot who is in the last 12 months of such category freeze may be awarded an AE or VD to another base for which qualification training is required if he is unable to be awarded an AE or VD to such base in his current position in a given posting. In such event, the balance of his existing category freeze will be added to the category freeze

The placement of the exception and the terms "such category freeze" and "last 12 months" don't seem to support anything other then application to pilots under the new freeze.

Three days under the new PWA and we already have an interpretation/implementation issue. Gotta love APC. You guys are arguing FOR the pilots, right?

This will continue to be entertaining. And I thought I'd quit reading after the PWA. Popcorn anyone? My prediction is sailing will take a company line on all these issues.

Actually, I think the pilot-friendly interpretation would be allowing any new hire with less than 12 months of seat freeze remaining to avail themselves of the new provision not just those who have incurred a 24 month freeze.
