Wow, I actually have something to add to a discussion...

This is covered under USERRA ... the law is that an employer has to give reemployment rights back to an employee after up to a cumulative of five years of military leave of absense. Here is the website that answers this an other similar questions about this section of employment law...

USERRA FAQ

Here is the section covering the 5 years cumulative stuff...

What criteria must the employee meet to be eligible under USERRA for reemployment after service in the uniformed services?
  1. In general, if the employee has been absent from a position of civilian employment by reason of service in the uniformed services, he or she will be eligible for reemployment under USERRA by meeting the following criteria:
    1. The employer had advance notice of the employee's service;
    2. The employee has five years or less of cumulative service in the uniformed services in his or her employment relationship with a particular employer;
    3. The employee timely returns to work or applies for reemployment; and,
    4. The employee has not been separated from service with a disqualifying discharge or under other than honorable conditions.
I have to give props to my wife. She's a lawyer and she became an expert when I was activated in 2003 from my job.

Thanks for the info. Activated? And you're a C-17 flyer? You guys need a better union! Our KC-10 reservists have a very good gig going; they decide if they want to fly or not.

I know guys that have asked for and received approval from Delta to stay out longer than 5 years. I wouldn't accept a phone approval though, definitely need to get it in writing. If you want to stay out beyond 5, you're depending on the company's good graces to bring you back.

Here is a question for anyone since we have wondered on the topic of Mil leave... Does anyone know if travel benefits stay in place during mil leave? Employee, family, buddy passes?

I figure I'll find out next month when my wife try's to non-rev, but it would be nice to give her the heads up if she needs to buy a ticket.

Mil leave greater than 30 days causes loss of medical/dental. However travel benefits remain in effect.

I would double check on the travel side. I believe you get some benefits but not the normal passes. You might revert to S3B and I think the IRS requires you pay taxes on the imputed value of the tickets.

I recently when on an extended period of MLOA (many months) that covered a few months of 07 and into 08. There is absolutely no change to your pass privileges or status. As for the taxes, my accountant never mentioned anything last spring for my 07 return, and I did not see anything unusual on the return...of course I might being paying penalties and interest in a few years if Sailing is correct.
As far as Med/Dental goes...Split is correct...but there is another important detail no one ever tells you. Delta stops paying their share of the premiums, but the coverage is not cancelled. A few months into your MIL leave, you will get a huge bill for all the premiums Delta stopped paying. You must contact the benefits dept when you first go on leave, and tell them to cancel your coverage. They will require you to send them the request in writing. It was a major undertaking to get them to forgive literally thousands of $ in premiums they wanted from me. Fortunately, I had switched to Tricare and never used the Delta insurance during the MIL leave period, so they were eventually willing to back date the policy cancellation. It took a lot of a$$ kissing, phone calls, e-mails and faxes to get it done though!!

Delta loves the military because they get a stable, known, well-trained, well-educated pilot. They don't love spending lots of money on requals, only to have someone go back out for 3-5 years over and over, rinse, repeat.

I'm all for supporting the guard and reserves - did it for a while myself - but I always viewed Delta as my primary employer, AFRES when it fit into my DL schedule.
