I didn't say cognac and breadsticks. You can have Scotch in economy or B/E. Regardless of where he sat in the cabin, the point is that he didn't belong in the cockpit.

OK, seems like we're struggling with why the third guy is there, and whether he has to be there. At a minimum, he's there because the contract says so, and I think we want to be in the business of enforcing the contract.
Regardless of the reason, you've got three guys. You want to use the third guy? He needs to be rested, because he's liable. If you want to go the other way, like CAL used to, then let's put the relief in the cabin, with a Scotch in hand, for the outbound leg to Europe.

Which part of my post does the FAR disagree with?
Does the FAR have a specific rule for how to schedule rest for augmented crews that are FAR required, vs. how to schedule rest for augmented crews that are required by the PWA?
If you're flying with an augmented crew, and you don't comply with the rest assignments for augmented crews... are you legal just because your flight is < 8:00?
If your "relief" is not required, and you're not planning to rest them accordingly, then what are they doing in your cockpit?

Also, at half the credit.
Which is the same as the pick up time from the hotel. But... can you quote the part where hotels are excluded? As far as I am concerned, that should count also. IOW, it cannot start at scheduled pushback time I wouldn't think.
Here's a question, why does the "Relief Pilot" get any break at all??
He's only there to -Relieve- the other two pilots so they can get some rest. They are doing the actual flying, not him, right? So why should he get the same break as the two "Flying Pilots"?
