I know you are being polite. I just want to make sure I understand.
It seems to me that you are admitting that us operating the aircraft we fly in a safe manner is an implied provision of our contract. No?
Is there a difference between an express contractual provision and an implied contractual provision?
And yes; there's a difference between the two. However they're addressed differently in terms of the grievance process.

there are several thousand plus here from each group, meaning each group statistically speaking contributed some awesome pilots, a few bad apples, hundreds of insubordinate minded guys and hundreds of brown nosers and everything in between.

It's not an express or implied contractual provision. It's a company policy set forth in the FOM. The contract, besides book ending ASAP and FOQA with deidentification policies, has nothing to do with standard operating procedure, express or implied.
