All that said, I predict Tennessee beats Florida.

Scratch Miami from that list. The Marlins moved to Miami to their new stadium where the Orange Bowl used to be. Now the Dolphins share Joe Robbie stadium with the Hurricanes since the Hurricane's stadium was demolished to build the baseball stadium for the Marlins. Anyhow, the Dolphins play on all grass now.

I agree with Sailing's post, and FullofLuv, and Scoop especially. As a mil leave guy furloughed after 9/11, I worked my a$$ off after recalled at the very end of the recalls... and then I worked 5 days a week for the mil. I kept a chart of all the USERRA rules and all my orders, and I called Delta and informed them I was available for training anytime I hit a requirement to do so-- 7 days sometimes, until my next set of orders dropped. Most of the guys in my unit did the same, and we had academics on the USERRA requirements yearly.
I have absolutely no problem with Delta enforcing the USERRA as it is written. Problem is, it is extremely vague on the "5 years total mil leave" due to the exemption of orders for war or in support of it. Simple to figure out you think? NO! Between 2007 and 2011, there were at least 11 Undersecretary of the USAF proclamations making prior orders in support of GWOT.. entire series of orders which previously had NOT included the proper statement (due to no one realizing it needed to be there) were blanket covered. Vague statements on orders intent by the mil without the exact phrase "in support of ..." were later included by Under Sec. (All training activities involved in flying training for pilots deploying to Afghanistan during the period blah to blah are exempt per blah de blah...) The only court cases to my knowledge where a mil leave guy challenged the airlines (United, USAir), the airline lost to the tune of 10$million. If you're the mil member, how are you going to substantiate the exempt status of orders over 5 years, all written by 20 year olds making 4$/hour and trained less than 1 year, with 10-20 DoD exemptions and after the fact rule-making that no one has ever seen? If you're Delta, how are you going to spend the time being sure enough to challenge the poor bastard who had to generate his case?

Of approx 85 pilots in my sq, I'd say there were maybe 3 abusers. Those guys should have been disallowed to return, and I'd have no problem with an airline enforcing the USERRA against them. But there were 82 guys who absolutely complied with the intent, who were happy to just GET their orders and paid 2-3 weeks late... who were NOT going to turn those orders back in for a re-do "hey guys, you forgot to put 'in support of GWOT' on these, can you re-do them? And don't forget, I'm in line with the other 85 guys hoping for orders next month too!".

Scoop is right--of 240 guys or so out on mil leave still, 80% are not coming back due to having other jobs. Of the 45 left, 40 are solid. Maybe 2 guys are skirting it and 3 guys are clearly NOT valid. Fine, don't rehire the 3 guys. This is completely a non-issue.

But after furloughing 1300 guys for 5 years, and those guys scrambling to find a job, and after 11 years gone mostly working for the mil... are you really going to b it ch and moan about these 5 guys????? Take a look at the SICK LIST and disability list --almost 1000 pilots out on sick! I think if you're in a mood for getting your Witch Hunt pitchfork out, there are much more fertile areas to look than the mil leave...

As far as Military guys coming in ahead of junior guys - where else should they come in but at their seniority number?

The "bad" behavior Sailing describes is fraud - pure and simple and should not be tolerated. But this behavior is not limited to MIL LV but also includes:

Fraudulent Scam Divorces
Faking disability
Fraudulent dependents
And probably a dozen or more scams that we can't even think of.

Its a shame a few Tools create so much angst and trouble in the system. To the junior guys worried about the 250 or so guys coming back from MIL LV - don't sweat it. If they did not stay out on MIL LV, 250 or so of you would not even have been hired in the first place. Out of that number I bet the fraudulent issues that Sailing describes can be counted on one hand.

And finally - if the Military did not respond so aggressively after 911 taking out the Taliban how much international flying do you think the Airlines would have been doing this last decade if some more 911 style attacks had occurred. My guess is that it would have been a lot less.

Look at the big picture guys.
