the baker was his own boss, and the reason it was a free speech issue is he was being sued to be compelled by the state to do something. If he had been a regular employee, the bakery could have fired him, but the state of Colorado could not force him to make a cake a certain way.

the first amendment protects you from the government for what you say. that’s why, for example, you cannot be arrested for saying something racist, homophobic, ect, but your employer can absolutely fire you for that.

pretty much the only 1A protections from employers have to do with unions. DL cannot ban AFA pins for example

this is no more a 1A violation than DL saying we can’t have political bag stickers or bring politics into a PA.

This is all correct. The first amendment does not apply to corporations. There may be some laws that the government can enforce regarding equal opportunity. For example, if you are permitted to have a Bible on your desk and are punished for putting a Quran, you might have grounds for discrimination based on a protected class.

To me this makes sense, especially as geopolitics gets more tense over time. How exactly is Delta expected to manage a problem between coworkers when it stems from one wearing a Palestinian pin and the other an Israeli pin? Unless they are to pick a side it's only going to cause headaches for them. I can see why they encourage LGBTQ flare since most customers seem to generally be ok with not discriminating against those groups (despite whatever political views prevail among pilots on the matter), but for a large corporation to pick a side on something like this would be like letting employees wear pro-choice/pro-life tags at work.

If this is the standard for a pin on the uniform then are you saying customers are ok with discriminating against Palestinians?

This was my first thought. Isn't a language flag pin quite necessary from a customer service or safety standpoint? Of course, Hamas flag pins would not fall into this category.
