Somewhat disappointing that the union hasn't gotten the company to cease and desist on that little scheduling maneuver. There is no PWA provision that allows the company to assign you a trip while you are on vacation and then give you "vacation payback days." Company/schedulers just don't want to go to the next option - assign with conflict. By taking that trip, the pilot is helping the company bigly.

Not at the time of a trip....read 7.F. Any purchase/cancelling of vacation must be done well in advance. The company has been calling guys on vacation to IA them trips then giving them "vacation payback days." That is expressly verboten by 23.A.16.

They cancel your vacation due to training too close to the end of the vacation year and there are no vacation weeks left to bid.
The pilot has the option to roll it into the next year or cash it out.
It happened to me in the past. I got cash instead of a useless vacation week in March.

We can't allow the company to go "off contract" to fix their own issues even if that means individual pilots get something they want. If that's truly how it happened, we need to grieve it and make them pay for the contractual violation.

Yup.....see my previous post. Either the pilot accepting is unaware this is prohibited or knows and just wants the money. In either case, it hurts the pilots as a whole.

Cancellation of Vacation1. The Company will:a. not cancel an awarded vacation unless due to operational necessity, and b. make: 1) every effort to avoid canceling an awarded vacation, and 2) every reasonable effort to recall a furloughed pilot in order to avoid cancellation of an awarded vacation. Note: In a bid period in which there is a furloughed pilot who has not been offered recall, the Company will not cancel more than 50% of the awarded vacation weeks in a category. 2. A pilot will receive at least 30 days advance notice of the cancellation of an awarded vacation period. Exception: A pilot may receive less than 30 days advance notice in the event of an emergency that precludes such notice. The Company will notify such pilot promptly and forward to him a letter of confirmation at the earliest possible date.
Crew scheduling has since early summer been violating the contract repeatedly to cover trips. The one I have seen multiple times is improperly moving trips from base to base where they did not follow their own reserve only notation. Rumor has it our union scheduling section is in disarray and not doing the job it used to do to police things.

It isn't defined but I think the Company would be hard pressed to stand in front of the System Board and try to convince the neutral that cancelling the pilot's vacation within 24-36 hours of a rotation was due to an "emergency," especially when the Company has not fully exercised the 23.N Long Notice Ladder (i.e., GSWC and IAWC).
