I once had a "debate" with the Duty Officer when they wanted to send me to Brazil with the MD-11 Crew Rest MEL'd INOP. I told him he was required to swap airplanes or AT LEAST get me a futon.
He eventually found me a new futon (GOC said none were available).
Long story short ... I researched this after I got to Brazil, and ... what R1200RT said above was the only thing I could find in the FAR's.

FBH - I know the rules on times. My point was where in FAR's is it allowed that the "crew rest" will be in a cockpit jumpseat? The company has tried to pull this before when sending a MD10-30 to CDG and having the courier seats broken (MEL'd as do not occupy) and no futon on board!

But the Operating crewmember needs a place to "rest" when the RFO is occupying a window seat. A reclining cabin type seat with footrest like most of the courier seats on the MD (although the "footrest" part of it is marginal at best) qualifies for this requirement. A cockpit seat does not!
