The second to last paragraph says it all, FedEx and UPS are not responsible for determining who is acting within the law yet the Feds (who are responsible for that determination) will not provide the list. The mere act of shipping drugs from a pharmacy to a recipient with a prescription is not illegal. Where does that responsibility end, if someone ships stolen parts and does not disclose that to the shipper is the shipper still liable?

FedEx was more defiant. Fitzgerald said the company has no plans to plea bargain with federal officials.


Defiant is a good word for our legal department. They went after HKG pilot #4 with considerable zeal but then offered mediation and sealed the settlement details. Fire first, determine guilt later is their motto.

Possible newhires beware. Any legal papers that seem to be vague do not give YOU latitude. They only give corporate latitude.

It is funny how the US Postal Service is not included in the investigation. What no illegal pharmacies use their " one rate, if it fits it ships". More likely, since UPS and FDX make billions and USPS loses billions, DOJ is just trying to EXTORT money from successful companies. Is this the future of the US.

DOJ investigators based out of San Francisco. Last I heard they were teamed with the San Francisco City Council in helping eliminate Mickey D’s Happy Meals. Times are tough for the DOJ boys in NorCal. Guess they needed to drum up some publicity and pad their end of the year stats.

During college I loaded trucks for UPS and they told us at orientation they were the largest shipper of illegal drugs in the country (not by choice obviously).

Big Pharma and uncle sugar have been cut out of the pattern by these discounters and it makes them very angry.

There is a shortage of about 15 billion at the post office, so no money to be had there. After all, what would be the point of going after your own racket when the other rackets are doing far better.

This is less about law and more about profit, less about guilt and more about going after the conduit instead of the instigators.
